Are you considering divorce? If so, you may want to explore a growing alternative to a traditional divorce, collaborative divorce.

Although divorce is never easy, a collaborative divorce is an approach that can make the process easier and less expensive for everyone.

In a collaborative divorce, both parties agree to not litigate (go to court) or threaten the other with going to court. Rather, the husband and wife sit down in a room with their two lawyers and everyone works together to come up with a divorce agreement that is agreeable to both parties.

There is necessary give and take, but the atmosphere is less adversarial and more about finding opportunities to maximize the resources needed for both parties to move forward with new lives. This includes conserving resources that can be used for children’s care and education. Sometimes consultation of a divorce financial expert can identify ways that certain assets can be more beneficial for one party than another, and therefore strategic decisions can be made jointly to benefit the entire “family”.

A traditional process inherently discourages errors of omission from being revealed, as they may not be in the other party’s best interest to disclose. A collaborative environment where all information is shared may help prevent a damaging omission from going undetected.

When pursuing a collaborative divorce, the following guidelines are agreed upon…

  • The lawyers working on the case cannot go to litigation if the collaborative efforts fail; this means the husband and wife will need to hire new lawyers if the process fails
  • Neither party takes advantage of mistakes made by the other party
  • Both parties disclose all information
  • The settlement decision remains confidential
  • All expert are hired by both parties and maintain a neutral position
  • Everyone is to behave courteously and respectfully
